DOLPHLINK TERMS OF SERVICE

1. Agreement and Parties

This Terms of Service agreement ("Agreement") is entered into by and between DolphLink Pte. Ltd., a corporation incorporated under the laws of the Republic of Singapore (hereinafter referred to as "DolphLink", "we", "us", or "our") and the individual or legal entity utilizing our Services (hereinafter referred to as "User", "Customer", "you", or "your"). If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms.

2. Definition of Services

DolphLink provides various electronic communication services, including but not limited to global cellular connectivity, roaming data packages, international eSIM (Embedded Subscriber Identity Module) profiles, physical SIM cards, software applications, enterprise IoT communication solutions, and associated management platforms available via www.dolphlink.com (collectively, the "Services").

3. Eligibility and Account Registration

1. Age Requirement: You must be at least eighteen (18) years of age, or the legal age of majority in your jurisdiction, or have explicit parental/legal guardian consent to contract.

2. Account Accuracy: You agree to provide accurate, current, and comprehensive information during registration (including full name, email address, and billing details) and keep this information updated.

3. Device Compatibility: For eSIM services, you are solely responsible for ensuring that your mobile device is carrier-unlocked and technically compatible with eSIM technology. DolphLink will not issue refunds for purchases made for incompatible or locked devices.

4. Service Delivery, Usage, and Restrictions

  • Service Availability: DolphLink utilizes multi-network roaming infrastructure and local partner networks globally. While we endeavor to provide seamless, uninterrupted coverage, the quality and availability of networks may be subject to interference, network congestion, or third-party carrier faults. We do not guarantee 100% continuous coverage.
  • Fair Usage Policy (FUP): To safeguard network equity, certain data packages are bound by a Fair Usage Policy. If a Customer's data volume exceeds reasonable thresholds within a specific timeframe, DolphLink and its network partners reserve the right to throttle connection speeds or suspend data transmissions.
  • Prohibited Activities: You strictly agree not to use the Services for any unlawful, fraudulent, defamatory, or malicious acts violating Singapore laws; or reselling the connectivity without express written commercial authorization from DolphLink.

5. Fees, Payments, and Refund Policy

  • Pricing & Taxes: All tariffs are posted on our official website or application interface, and are exclusive of applicable local taxes or Singapore Goods and Services Tax (GST) unless stated otherwise.
  • Refund Policy: Due to the digital nature of telecommunications provisioning (specifically eSIM downloads), all sales are final and non-refundable once an eSIM profile is deployed, downloaded, or activated, except in documented cases of absolute technical failure attributable entirely to DolphLink's internal systems.

6. Limitation of Liability

TO THE MAXIMUM EXTENT SANCTIONED BY APPLICABLE SINGAPORE LAW, IN NO EVENT SHALL DOLPHLINK, ITS DIRECTORS, OR SERVICE PARTNERS BE HELD LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS OR DATA LOSS). THE CUMULATIVE LIABILITY OF DOLPHLINK SHALL NOT EXCEED THE TOTAL AGGREGATE FEES PAID BY YOU TO DOLPHLINK WITHIN THE THREE (3) MONTH PERIOD IMMEDIATELY PRECEDING THE CLAIM EVENT.

7. Governing Law and Dispute Resolution

This Agreement shall be exclusively governed by and interpreted under the laws of the Republic of Singapore. Any dispute, claim, or controversy arising out of or in relation to this contract shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre ("SIAC") in accordance with the Arbitration Rules of the SIAC in force at the time of commencement. The seat of the arbitration shall be Singapore. The language of the arbitration shall be English.
